Erin Winning joined Brown Wright Stein Lawyers in January 2013 and practices in commercial litigation.

Erin has experience working in a wide range of commercial matters involving property disputes, insolvency, partnership disputes, taxation disputes, Corporations Act disputes including breaches of directors’ duties and debt recovery. She regularly advises national corporates, smaller owner-managed business and high net worth individuals across jurisdictions in New South Wales including the District Court, Supreme Court and Federal Court. In addition, Erin has experience in navigating disputes to negotiated settlements.

Erin’s recent experience includes:

  • Acting for a national retailer in respect of a breakdown of partnership

  • Advising and acting for a large network of companies in respect of their tax affairs and proceedings commenced by the Deputy Commissioner of Taxation

  • Advising and acting for creditors in wind-up applications in the Federal Court and Supreme Court

  • Advising and acting for a high profile hospitality group in respect of their dispute with a Sydney arts venue

  • Advising and acting for a high net worth individual in respect of defamatory statements published in a high profile book

  • Acting for plaintiffs and defendants in respect of disputes involving breaches of contract

She is currently studying Master of Laws (LLM) at the University of Technology Sydney.

Erin enjoys playing netball, both outside of work and with Brown Wright Stein’s netball team during their lunchtime tournaments, and enjoys samba and reggaeton dancing.

Call when you want, but there's no one home, and you're not gonna reach my telephone! The "Right to Disconnect" becomes law

Employees will have the right to disconnect from work outside normal working hours, after amendments to the Fair Work Act 2009 (Cth) were recently passed.

Importantly, nothing in the new law suggests that an employer cannot contact an employee outside of their normal working hours. Rather, the amendments mean employees may refuse to monitor, read or respond to contact, or attempted contact, from an employer or third party outside of the employee’s working hours unless the refusal is unreasonable.

Remove Unfair Contract Terms before 9 November 2023

From 9 November 2023, changes to the Australian Consumer Law (ACL) will impose heavy penalties on businesses proposing, using, or relying on unfair contract terms in standard form contracts with consumers and small businesses. Businesses need to review their standard form contracts now and remove any unfair contract terms to avoid substantial penalties.
