Dispute Resolution
Cherrie Homer joined Brown Wright Stein Lawyers in October 2012. She has acted for many different clients on dispute matters including banking and financial institutions that deal with secured and unsecured lending, compliance and consumer credit issues.
Cherrie’s experience includes:
Assessing security interests;
Investigating and advising clients on potential claims.
Executing claims that incorporate complex equity issues, competing priorities and issues of subrogation.
Conducting matters that span multiple jurisdictions and involve numerous areas of the law.
Investigating and advising on fraud matters.
Advising on professional negligence claims and liaising with the Solicitors Regulation Authority and the NSW Law Society Fidelity Fund.
Reviewing, interpreting and comparing legislation.
Advising clients on their prospects of success and the defences available to them and compliance with industry codes and standards.
Drafting documents including deeds, claim forms and witness statements, releases, security documents, sale agreements and secured guarantees.
Starting and maintaining Court Proceedings.
Instructing Counsel.
Liaising with regulatory bodies and providing responses to the ACCC, ASIC and Credit Ombudsman for customer complaints and alleged breaches.
Liaising with insolvency practitioners in relation to individual and corporate insolvency, and issuing and conducting proceedings for petitioning creditors.
Outside of work Cherrie enjoys the cinema, the theatre and sailing.
